@SeptimusBrown Also, in your case, I question if a newsletter thst intends to inform rather than solicit business is a marketing material. Still, the healthiest choice is to obtain explicit consent. Personally, I don’t want anyone to solicit me. It turns me off to the brand.
@SeptimusBrown I’m a lawyer. Generally, if individual gave their email for a business purpose, purchased from your brand within 2 years, or a few other scenarios, you can interpret that as implicit consent to receive marketing materials. Still, best to obtain explicit consent.
